Special Terms and Conditions for International Purchases (Export Terms) – Budi AB

1. Background

1.1. Objects sold on budi.se ("the Website") may be exported within or outside the EU where this is stated in the listing description. In the case of export, no Swedish VAT is charged on the object, provided that the buyer satisfies the requirements for VAT-exempt sales.

1.2. These special terms and conditions for international purchases (export terms) ("the Export Terms") supplement and apply in addition to the User and Auction Terms and Conditions for Business Operators in force from time to time, with respect to the export from Sweden of objects purchased by the buyer through the Website or otherwise through BUDI AB (reg. no. 559246-0421) ("Budi", "we", "our" or "us").

2. Terms for Sales to Destinations Outside Sweden

2.1. Budi charges an administrative fee in accordance with the price list in force from time to time for each object to be exported.

2.2. Vehicles and registered objects must be insured before being taken out of Sweden. Insurance documentation must be provided to Budi and must be available for presentation on request.

2.3. All customs charges, road tolls, duties, fines, parking fines, inspection fees or other charges incurred after collection of the object and during any period in which Budi remains registered as owner in the Swedish vehicle register are charged directly to the buyer, together with an administration fee in accordance with Budi's price list in force from time to time.

3. VAT-Exempt Purchases Within the EU – Business Operators

3.1. Under Swedish VAT legislation, which implements the EU VAT Directive, intra-EU supplies of goods are normally exempt from VAT at the point of sale, provided that the seller can substantiate the supply through appropriate documentation and has a valid VAT number.

3.2. The buyer must provide a valid VAT number before purchase. This will be verified through VIES (VAT Information Exchange System) to confirm its validity.

3.3. If the VAT number is valid, the buyer will not pay Swedish VAT but will instead account for the intra-EU acquisition for VAT purposes in its own country.

3.4. The buyer must provide written documentation that the object has left Sweden, for example by means of a CMR consignment note and proof of delivery.

3.5. The buyer will also not pay Swedish VAT on transport and other services performed within Sweden, but will instead account for these for VAT purposes in its own country.

3.6. If the buyer does not hold a valid VAT number, Swedish VAT will be charged on the objects, the buyer's premium (service fee), and all other fees, transport and services within Sweden.

4. VAT-Exempt Purchases Outside the EU – Business Operators

4.1. If the VAT number is approved, the buyer will not pay Swedish VAT. The buyer shall instead account for VAT on the purchase in its own country in accordance with the regulations applicable there.

4.2. The buyer must provide written documentation that the object has left Sweden, for example by means of a CMR consignment note and proof of delivery.

4.3. The buyer must submit to Budi documentation demonstrating that it is a business operator, for example a certificate of registration issued by the relevant local authority. Documents evidencing who is authorised to sign on behalf of the company, as well as authorisation documents such as a power of attorney, must also be presented before collection.

5. Deposit

5.1. For objects to be transported out of Sweden, a VAT-exempt deposit is charged where Swedish registration plates for vehicles are borrowed from Budi, as follows:

  1. SEK 5,000 for objects with a value between SEK 0 and SEK 100,000.
  2. SEK 10,000 for objects with a value exceeding SEK 100,000.

5.2. The deposit is refunded within 14 days of receipt of valid export documents and return of the borrowed registration plates to the address specified by Budi. Export documents must be received by Budi no later than 14 days after collection of the object for the deposit to be refundable without deduction. Thereafter, a deduction of 10% of the deposit amount is made for each commenced week during which valid export documents have not been received. Deductions are not refunded to the buyer.

5.3. The deposit may only be returned to the same account used for payment of the object and the deposit.

5.4. The buyer must provide Budi with: (i) IBAN account number; (ii) BIC/SWIFT code; (iii) the account holder's full and correct name; and (iv) all such other information as Budi may require to process payment in accordance with applicable rules, including in connection with a deposit refund.

6. Export Documentation

6.1. The buyer is solely responsible for obtaining the customs documents and export declarations required to export the object from Sweden.

6.2. For export to other EU countries, the required documentation includes, among other things: (i) valid export documents (for example, a CMR consignment note); (ii) a registration certificate in the destination country or a temporary transfer permit; and (iii) a completed export declaration (customs declaration or customs confirmation).

6.3. For export outside the EU, the required documentation includes, for example, customs documents or a registration certificate in the destination country.

7. Collection, Transport and Restrictions in Connection with Export

7.1. The buyer is fully responsible for the transport of the object from the collection point to the final destination, including all costs, insurance and risks associated with the transport.

7.2. The risk of loss passes to the buyer at the time of collection.

7.3. Before, or at the latest at the time of collection, the buyer must, in addition to the requirements set out in the User and Auction Terms and Conditions, also present proof of address, such as a bank statement or utility bill.

7.4. If a representative is to collect the object, the buyer must notify Budi of the representative's identity before collection. Notification may be sent to hello@budi.se. The power of attorney must satisfy the requirements set out in the User and Auction Terms and Conditions.

7.5. Budi does not export objects to countries that are subject to restrictive measures or that are covered by applicable international economic sanctions laws, regulations, trade embargoes or similar restrictive measures.

7.6. Budi reserves the right, at its sole discretion, to refuse export outside Sweden, rescind the purchase and refund the purchase price paid, where circumstances so require.
